Kurgan is OBVIOUSLY wrong about Canon 188.4
Sometimes the answer to a question has been staring you right in the face the whole time. 118.4 cannot possibly mean "loss of clerical state" or "no longer a cleric". For a quick review, here's Canon 188.4 from the 1917 Code:
Canon 188.4 - Any office becomes vacant upon the fact and without any declaration by tacit resignation recognized by the law itself if a cleric publicly defects from the Catholic faith.
The key to this whole disagreement is in the word RESIGNATION.
Let’s start with all of the applicable definitions:
TACIT - Not spoken. Implied or inferred from actions or statements. Not speaking; silent.
TACIT (Webster’s 1828) - adjective [Latin Tacitus, from taceo, to be silent, that is, to stop, or to close. Silent; implied, but not expressed.
RESIGN - To give up (a position, for example), especially by formal notification. To relinquish (a privilege, right, or claim). Synonym: relinquish
RESIGN (Webster’s 1828) - verb transitive [Latin resigno; re and signo, to sign. The radical sense of sign is to send, to drive, hence to set. To resign is to send, to drive, hence to set. To resign is to send back or send away.
1 - To give up; to give back, as an office or commission, to the person of authority that conferred it; hence, to surrender an office or charge in a formal manner; as, a military officer resigns his commission; a prince resigns his crown.
RESIGNATION - The act or an instance of resigning. An oral or written statement that one is resigning a position or office. Unresisting acceptance of something as inescapable; submission.
RESIGNATION (Webster’s 1828) - The act of resigning or giving up, as a claim or possession; as the resignation of a crown or commission.
So, we can see that there is a resignation, and that it is silent. Let’s continue….
This was my response in a previous post to the 188.4 canon debate:
This is what the text says, but “office”does not mean clerical state. You cannot resign from being a priest. Holy Orders must be removed through the external forum (more on this later).
So, where did kurgan get this notion that ecclesiastical office equals clerical state? Let him tell you:
That’s right, he took it UPON HIMSELF to combine the terms ecclesiastical office, clerical office, and clerical state, for SIMPLICITY. He just made it up! After all, he wouldn’t want you people that aren’t as smart as him reaching a conclusion that might not agree with him. He’s just saving you the trouble of all that pesky reading and research. What a guy!
Kurgan's GREAT CONFLATION is that ecclesiastical office = clerical state = no longer a cleric.
LIE.
CONCLUSION
1 - Canon 188.4 requires a silent resignation.
2 - You cannot resign from the priesthood.
3 - Therefore, canon 188.4 means only offices, and NOT clerical state.
If you disagree with this, all you need to do is show ONE PRIEST that has resigned from the clerical state. You can start by searching google using the words “catholic priest resigns” or something similar. You will see that no matter what the circumstances, know matter how horrible the crime, the man remains a priest and does NOT lose his clerical state. YOU WILL NOT FIND ONE THAT LOSES CLERICAL STATE.
“For he testifieth, Thou art a priest for ever, according to the order of Melchisedech” (Hebrews 7 :17).
So, here’s two simple "yes/no" questions for kurgan and his “kurganites”
“Can a priest, tacitly or explicitly, resign from the priesthood?” OR, in other words:
“Can a priest resign from the clerical state?”
My answer is “NO” and "NO"
What’s yours? Just a reminder:
“But let your speech be yea, yea: no, no; and whatsoever is more than these is of the evil one” (Matthew 5:37).
